DUII ARREST PROCESS
The arrest process for those accused of driving under the influence generally occurs as follows:
· Driver is stopped by a police officer. This usually occurs during a traffic stop.
· The police officer conducts field sobriety tests.
· If a DUII suspect fails the field sobriety test, the suspect is usually arrested or given an on-site blood alcohol test.
· Suspect is taken to detox center and given BAC test.
· The suspect is booked and placed in custody. The suspect may arrange for bail.
· The suspect then has an arraignment and will receive a court date for further proceedings. This is the final stage of the arrest process.
Once the DUII defendant has been arraigned, the Court will have jurisdiction over the defendant. The case will then proceed through the court docket, a DUII charge may include the following:
