DRIVING UNDER THE INFLUENCE OF INTOXICANTS "DUII"
The terms DUII, DUI and DWI all refer to the criminal charge of "drunk driving". In legal terms the charge is called "Driving Under the Influence of Intoxicants". The term DUII is used by most lawyers, police officers and Judges. This website will use the terms interchangeably.
A person commits the offense of driving under the influence of intoxicants if the person drives a vehicle on a premises open to the public while the person:
a. Has .08 percent or more by weight of alcohol in the blood of the person as shown by chemical analysis of the breath or blood of the person;
b. Is under the influence of intoxicating liquor or controlled substance; or
c. Is under the influence of intoxicating liquor and a controlled substance.
Misdemeaner DUII. Generally, driving under the influence is a Class A misdemeanor. A conviction for misdemeanor drunk driving carries a maximum jail sentence of one year and a $6,250 fine. The fine may be increased to $10,000 if a minor is in the vehicle.
Felony DUII. Driving under the influence of intoxicants is a Class C felony if the person has been convicted three driving under the influence offenses in the ten years preceding the date of the current offense.
