Driving While Suspended (Misdemeanor) - ORS 811.182
DUII defendants that drive when they know their license is suspended, revoked or violate the limits of their hardship permit can be charged with Misdemeanor Driving While Suspended.
Oregon law provides that a person commits the crime of driving while suspended if that person drives a vehicle on a highway or premises open to the public (1) during a period when the person’s driving privileges or right to apply for driving privileges have been suspended in this state by a court or by the Department of Transportation (2) outside the limitations of a probationary permit or a hardship driver permit (3) during a period when the person’s driving privileges or commercial driving privileges have been suspended or revoked in this state or any other jurisdiction
Driving While Suspended (Misdemeanor) is a Class A Misdemeanor which carries a maximum penalties of 1 year in jail and a $6,250 fine.
