Failure to Perform Duties of a Driver (Hit and Run) - ORS 811.700, ORS 811.705

 

A DUII defendant that is involved in an accident with another vehicle either attended or unintended or who injures a person may be charged with the Failure to Perform the Duties of a Driver, if that person leaves the scene of the accident without providing the required information.  This crime is commonly referred to as “hit and run”.

 

Oregon law provides that a person commits the crime of failure to perform the duties of a driver when property is damaged if the person is the driver of any vehicle involved in an accident resulting in damage to fixtures or property legally on or adjacent to a highway and the person does not do all of the following:

(1) Take reasonable steps to notify the owner or person in charge of the property of the fact an accident has occurred and of the driver’s name and address and of the registration number of the vehicle the driver was driving; and

(2) On request and if available, exhibit any document issued as official evidence of a grant of driving privileges to the driver.

 

This charge may be avoided by providing a proper exchange of information at the scene of the accident.  This would include the DUII defendant’s name, address, telephone number, license plate number and insurance information.

 

Hit and run is a Class A Misdemeanor which carries maximum penalties of one (1) year in jail and a $6,250 fine.  A conviction can result in a suspension of your driver’s license and a judgment of Restitution for the damages caused.
